After a plebiscite on 20.03.1921 that was to decide on the shape of Polish–German border in Upper Silesia and indicated that Modzurów would remain in German did not leave despite constant harassment his parish.
Murdered by a German gang during an attack on his rectory after III Silesian Uprising in 1921 when was then border dispute was finally settled.
On 16.12.2021, the Senate of the Republic of Poland declared in a special resolution: „The bestiality of the murder is evidenced by the fact that after about 10 shots in the back, head and heart, the murderers pierced the victim's neck, cheeks and tongue.
The body of the shot priest was found after 8.00 p.m.
between the church and the presbytery”.
The resolution further stated: „the instigators and perpetrators of the crime were neither detected nor apprehended.
The German state authorities did not strive for this.
The entries in the parish chronicles […] [were, however] unambiguous: 'The murder of priest Augustyn Strzybny was committed by members of the German Selbstschutz'”.
