Investigation of the Institute of National Remembrance Rzeszów S 68/09 / Zi: „On April 19, 1944, at dawn, shortly after the residents had dispersed to their homes at night, the village was encircled and carts with men in German uniforms drove into its center, as well as dressed in civilian clothes. They demanded that the mayor named K. convene a meeting under the pretext of taking away the weapons from the inhabitants. at the same time, men were shot in the presence of their families. The perpetrators set fire to the buildings. Soon the wooden, thatched buildings caught fire. The attackers threw grenades into basements and shelters, fired firearms inside them and at the same time closed the doors from the outside, knowing that there were men, women and children in these rooms. Residents were also deprived of their lives in the ravine where part of the population was taking refuge. after the attackers had left, the German army arrived in the ruined village, which departed after reconnaissance. In several cases, the inhabitants of Rudka recognized the Ukrainians living in the villages adjacent to Rudka among the attackers. However, their identities could not be established. By the judgment of the Provincial Court in Rzeszów, the Regional Center in Przemyśl of June 24, 1960, file ref. VII K 21/60, Jan Sz. «Żeleźniak» was found guilty, inter alia, for the fact that, acting in favor of the authorities of the German state, he organized a branch of the UPA, which he commanded directly, he took part in the murders of the Polish population, in particular in the villages of Gorajec, Chotylub, Cieszanów, Kowalówka and Rudka, where on April 19, 1944, directing the attack on Rudka, he participated in the murder of about 75 people. Based on the literature, Jan Sz. «Szum» died in September 1947, Teodor B. «Bałaj» died in May 1946, NN «Gonta» died in June 1947, and Grzegorz M. «Kalinowicz» was sentenced to death, which was carried out. The events under investigation were considered to be crimes of genocide, since they were not a spontaneous act, the attacks were carried out by organized military formations, and the course of the events, their planning, regularity, size and effects indicate that their purpose was to cause the Polish population to leave these areas irretrievably. This political goal pursued by armed formations was outlined by the leadership of the OUN–UPa. The activities carried out did not reveal the perpetrators of the murder of antoni Sz., The attempted murder of Franciszek W., the murders of Marcin M. and adam Ch. By the decision of September 7, 2009, the investigation in items 1, 2 and 4 was discontinued due to the failure to identify the perpetrators of the crime, in item 3 in relation to Jan Sz. «Żeleźniaka» due to the statement that the criminal proceedings for the same act of the same person have been legally terminated, against Jan Sz.«Szuma», Teodora B. and Grzegorz M. in the face of the death of the perpetrators and the failure to detect the remaining perpetrators”. The Ukrainian report states: „LUBaCZOWSKIE: 19.4.44 UPA unit «Mestnyky2» destroyed the Polish village of Rudka. At 5.30 the unit entered the village and demanded from the village leader that the population should give up their weapons, otherwise the whole village would be burned.
